These Terms of Service (“Terms”) govern your access to and use of the Foundry application and website (the “Service”), operated by Novara (“Foundry,” “we,” “us”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 18 years old to use the Service. By using it, you represent that you are 18 or older and able to enter into these Terms.
Foundry generates and adapts personalized training plans, nutrition guidance, supplement suggestions, and optional devotional content based on information you provide, with the assistance of automated systems including artificial intelligence. Foundry is a general fitness and educational tool. It is not a medical device, a healthcare provider, a licensed trainer or dietitian, or a substitute for professional advice.
The Service — including all training, exercise, load, tempo, running, calorie, macronutrient, meal, and supplement recommendations, and devotional content — is provided for general informational and educational purposes only. It does not constitute medical, nutritional, psychological, or professional health advice, diagnosis, or treatment. Always consult a qualified physician or other licensed healthcare professional before beginning, changing, or continuing any exercise, nutrition, or supplement program — and especially if you have or suspect any injury, illness, or medical condition, are pregnant or nursing, or take any medication. Do not disregard or delay professional medical advice because of anything in the Service.
Physical exercise carries inherent risks, including serious injury, disability, or death, and nutrition and supplement changes can affect your health. You understand these risks and voluntarily use the Service and follow (or decline to follow) its recommendations at your own risk. You are solely responsible for your health, safety, and choices. Stop any activity immediately and seek medical attention if you feel pain, dizziness, shortness of breath, or any other symptom.
Nutrition targets, meal suggestions, and supplement suggestions are general information, not personalized medical or dietetic advice, and are not evaluated by any government health authority. Supplements can interact with medications and conditions — consult your physician or pharmacist before taking any supplement, and check ingredients and allergens for anything you consume.
Plans and responses are generated in part by artificial intelligence and may be inaccurate, incomplete, or unsuitable for you, and may not account for your full medical history. Use judgment and defer to a qualified professional. We do not warrant that any recommendation is safe or effective for you.
Results vary based on many factors outside our control. We make no guarantee of any particular fitness, body-composition, performance, or health outcome.
You are responsible for the accuracy of the information you provide, for keeping your login credentials confidential, and for all activity under your account. Notify us promptly of any unauthorized use.
You agree not to use the Service unlawfully; access accounts or data that are not yours; interfere with, disrupt, or reverse-engineer the Service; or resell, scrape, or misuse the Service or its content.
You retain ownership of the information and feedback you submit. You grant us a non-exclusive, worldwide, royalty-free license to use, store, and process it to operate, provide, and improve the Service.
The Service, including its software, design, and branding, is owned by us or our licensors. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own personal, non-commercial fitness use, subject to these Terms.
The Service is currently free. If we introduce paid features, the pricing, billing, renewal, and cancellation terms will be presented before purchase and incorporated into these Terms.
You may stop using the Service and delete your account at any time. We may suspend or terminate access for violations of these Terms or to protect the Service or its users. Sections that by their nature should survive (including Disclaimers, Limitation of Liability, and Indemnification) will survive.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY RECOMMENDATION IS ACCURATE, SAFE, OR EFFECTIVE FOR YOU.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVARA AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY PERSONAL INJURY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $100. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
You agree to indemnify and hold harmless Novara and its owners, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or third-party right.
We may update the Service or these Terms. If we make material changes, we will take reasonable steps to notify you and update the date above. Continued use after changes means you accept the updated Terms.
These Terms are governed by the laws of the United States and the state in which Novara is established, without regard to conflict-of-laws principles.
